Terms of Service (CGU)

These Terms of Service ("Terms") govern access to and use of the BestCoder platform ("Service") operated by BestCoder SAS, a French société par actions simplifiée registered in Paris under SIREN [pending], 8 rue de la Tour des Dames, 75009 Paris, France ("BestCoder", "we", "us"). By creating a BestCoder account or installing the BestCoder Agent, you accept these Terms in full.

1. Account creation

You must be at least 16 years old (18 in jurisdictions where required). You agree to provide accurate registration information and to keep your credentials confidential. You are responsible for all activity that occurs under your account.

2. Acceptable use

You may not use the Service to:

  • distribute malware, illegal content, or material infringing third-party rights;
  • attempt to circumvent BestCoder's authentication, rate-limiting, or billing controls;
  • generate, train, or fine-tune AI models on data you do not have the right to process;
  • run BestCoder for the benefit of a competing AI development control plane;
  • spam, scrape, or otherwise impose an unreasonable load on the Service.

We may suspend or terminate accounts that violate these rules, with reasonable notice when possible.

3. The BestCoder Agent

The BestCoder Agent is a signed binary you run on your own machines or infrastructure. The Agent connects to BestCoder's control plane via WebSocket only. Your code, secrets, and AI prompts never leave your machine; only metadata transits the control plane (project IDs, deploy timestamps, run statuses).

4. Intellectual property

You retain all rights, title, and interest in your code, your configurations, and any output produced by the AI providers you bring your own keys for ("BYOK"). BestCoder retains all rights, title, and interest in the Service, the Agent binary, and the platform code.

You grant BestCoder a non-exclusive, worldwide, royalty-free license to process your metadata strictly to operate the Service.

5. Subscription and billing

The Liberty plan starts at €19.99/month after a 1-month free trial. The Team plan starts at €59.99/seat/month with a minimum of 3 seats. Enterprise pricing is on quote. Payments are processed by Stripe.

You may cancel at any time from /settings. Cancellations take effect at the end of the current billing period. We do not pro-rate refunds for partial months unless required by law.

6. Service availability

We target 99.9% monthly uptime on the Liberty plan and 99.95% on the Team plan. Scheduled maintenance is announced at least 48 hours in advance via the status page (https://status.bestcoder.app). We are not liable for downtime caused by your own infrastructure, your AI providers, or force majeure events.

7. Disclaimer

The Service is provided "as is" without warranties of any kind, express or implied. BestCoder does not guarantee that AI-generated code is fit for any particular purpose, free of bugs, or compliant with your jurisdiction's regulations. You remain solely responsible for reviewing and testing AI output before deployment.

8. Limitation of liability

To the maximum extent permitted by law, BestCoder's aggregate liability under these Terms is capped at the amount you paid in the 12 months preceding the claim. We are not liable for indirect, special, incidental, or consequential damages, including loss of profit, data, or goodwill.

9. Termination

You may terminate your account at any time. We may terminate your access for material breach of these Terms with 30 days' written notice, or immediately for breaches of section 2.

Upon termination, your projects move to read-only for 90 days, then are permanently deleted. You can export your data at any time during this window.

10. Governing law

These Terms are governed by French law. Any dispute that cannot be settled amicably falls under the exclusive jurisdiction of the competent courts of Paris, France.
